One of the most glaring aspect  of Judicial sytem  in Pakistan is its weakness. How easily judges in pakistan can be disposed, replaced or fired. If none of the above then judges succumbs to pressure and give votes to sooth the present day government.


Through out the history of Pakistan there are numerous instances when the sanctuary of Judiciary system in Pakistan have been demolished. Some of the most famous in Pakistan history in no particular order are

• Justice Ikhlaq Ahmed was dismissed from his post because of his left wing views during General Ayub Khan tenure.

• Chief Justice S. Anwarul Haq adjourned the court until the end of July 1978, supposedly because 5 of the 9 appeals court judges were willing to overrule the Lahore verdict of Bhutto Hanging. One of the pro-Bhutto judges was due to retire in July

• Famous feud between Chief Justice Sajjad Ali Shah and Mian Nawaz Sharif which I think was one of the worst thing that could have happened for our judicial system. Among other things in this fued, famous Article 58(2)(b) a.k.a Eighth Amendment to the Constitution of Pakistan was restored and suspended within minutes by two separate benches of the apex court assembled against each other. It ended in the resignation of Justice Sajjad Ali Shah.

• May 12, 2000, the Supreme Court of Pakistan ordered Pervez Musharraf to hold general elections by October 12, 2002, which was in essence approving what the government wanted i.e legitimize Musharraf presidency .Musharraf also removed many of the Supreme Court Justices who had voted against his usurpation of power.

• On Friday March 9th, 2007 President General Pervez Musharraf virtually suspended the Chief Justice of Pakistan, Justice Iftikhar Mohammad Chaudhry, and appointed the available senior-most judge, Justice Javed Iqbal, as the acting Chief Justice of the Supreme Court.
